To implement the "Notice of the State Council on Printing and Distributing the '12th Five-Year Plan' Energy Conservation and Emission Reduction Comprehensive Work Plan" (Guo Fa [2011] No. 26) and the "State Council's Reply on the 12th Five-Year Plan for Air Pollution Prevention and Control in Key Areas" (Letter [2012] No. 146), it is essential to strictly enforce national motor vehicle emission standards and accelerate the improvement of air quality. Based on the relevant provisions of the Law of the People's Republic of China on Air Pollution Prevention and Control, the implementation of "compressed ignition and gas fuel for vehicles" has been formalized. The "Engine and Vehicle Exhaust Pollutant Emission Limits and Measurement Methods (China Phase III, IV, V)" (GB17691-2005) and the "Gas Fuel Ignition Engine and Vehicle Phase 5 Emission Limits" (hereinafter referred to as "National Five Standards") are now being enforced. The following matters are hereby announced:
1. Starting from January 1, 2013, all newly manufactured, imported, sold, and registered gas-fueled engines and vehicles must comply with the National Five Standards. Relevant enterprises are required to adjust their production, import, and sales plans accordingly.
2. Enterprises producing and importing gas-fueled ignition engines and vehicles must submit an environmental protection type approval application to the Ministry of Environmental Protection in accordance with the requirements of the National Five Standards. They should also submit an environmental production consistency assurance plan, annual reports, and vehicle identification code (VIN) information on time. Once approved, the Ministry will issue an environmental type approval certificate for the model.
3. As the main responsible party for vehicle emission control, automobile manufacturers must establish and improve their environmental production consistency assurance system. They should strengthen compliance management throughout the production process, ensure the quality of key environmental components, and conduct regular self-inspections of vehicle emissions. This will ensure that all vehicles produced and sold meet the National Five Standards.
4. The Ministry of Environmental Protection continues to enhance the consistency inspection of environmental protection in motor vehicle production. Through regular inspections and spot checks, it will comprehensively strengthen supervision over motor vehicle manufacturers. Those failing to meet the standards will be ordered to rectify within a specified period. If they remain non-compliant after the deadline, their environmental type approval certificates will be revoked and publicly notified.
5. Local environmental protection departments at all levels must strictly enforce emission standards during periodic vehicle exhaust inspections and the issuance of environmental protection qualification marks. Vehicles that do not meet the standards will not be issued with environmental inspection marks. These departments should also cooperate with public security traffic control agencies to prevent such vehicles from being registered within their administrative regions.
For the production, import, and sale of vehicles that exceed the standards, the Ministry of Environmental Protection, in collaboration with relevant authorities, will impose appropriate penalties.
